These General Shipping Conditions are drawn up in accordance with Legislative Decree no. 206 of 06.09.2005 (so-called Consumer Code).
Shipping costs are charged to the User except for ongoing promotions.
Packages are generally dispatched within 3 days of receipt of payment and are shipped via courier with tracking. Shipping costs include handling and packaging charges and postage. The management costs are fixed, while the transport costs vary according to the total weight of the shipment. We therefore recommend that you group the various items in a single order.
The User acknowledges that the withdrawal of the products represents an obligation deriving from the sales contract concluded with Modalyssa.
Deliveries will be made by express courier from Monday to Friday, excluding national holidays. The use of different delivery methods may be decided by Modalyssa according to the nature of the product ordered. In this case the change will be communicated to the User by e-mail.
Upon delivery of the products to the courier, the User will receive, by e-mail, a confirmation communication from Modalyssa, in which the name of the courier used and the details of the shipment will be expressly indicated.
The Products will be delivered to the postal address specified by the User in the order form.
The delivery terms indicated on the site are indicative and should not be considered essential, given that they are dependent on various factors.
The delivery of the products is considered completed when the User materially enters into possession of the products; from that moment, as per law, the risk of loss of damage to the products, for reasons not attributable to ModAlyssa, is transferred to the User.
In case of non-delivery due to the absence of the recipient at the specified address, the courier will leave a notice to certify the delivery attempt. The notice will indicate the data to contact the courier and define an appointment for delivery.
If the User fails to contact the courier to arrange a new delivery within about 4 days, the products will be returned to ModAlyssa
.
In the event that the products are returned to ModAlyssa, the contract must be considered terminated by law pursuant to art. 1456 cc, with simple communication from ModAlyssa sent by e-mail to the User, and, therefore, the order will be canceled for all purposes.
Within 15 days of the aforementioned communication, Modalyssa will then proceed to reimburse the total amount paid by the User for the products, less the costs of unsuccessful shipping, the costs of returning the products to Modalyssa and any other possible expense. that Modalyssa has sustained due to the non-delivery depended on the absence or inertia of the User in fulfilling the obligation to receive the delivery.
The reimbursement due pursuant to Article 8.10 will be credited to the same payment method used by the User.
After the communication of cancellation of the order, the User who intends to request the delivery of the products must necessarily proceed with a new order.
Modalyssa reserves the right to refuse orders from Users against whom the same has previously asserted the termination clause for non-fulfillment of the obligation to receive delivery of the products.
It is up to the User to check the conditions of the products delivered. Upon receipt of the products, the User is required to verify their conformity, paying attention, in particular, that:
- the number of packages indicated on the carrier's letter corresponds to the number of packages actually delivered;
- the package is intact and not damaged or tampered with.
Any anomalies found (such as, for example, tampering, damage to the packaging) must be specifically indicated in writing on the courier's transport document and the User must refuse delivery of the products. At the same time, the User will be required to report the fact to Modalyssa. The User is therefore invited to sign the transport document only after the verifications. If the User does not proceed in accordance with the verification, and, therefore, accepts the delivery of the products even in the case of damaged or tampered packaging, the same will void the warranty.
Withdrawal
If not satisfied with the purchase for any reason, the user can return the purchased products within 14 days from the date of receipt of the products, communicating the intention to withdraw via email [email protected].
The right of withdrawal is not provided for Users who are not Consumers resident within the EU.
Modalyssa offers its users the possibility to return products by accessing their personal area and clicking on "Product return", selecting the order for which you want to withdraw and define the products to be returned.
The user has 14 calendar days from the date of receipt of the package to carry out this operation.
Following the return request, an e-mail will be sent confirming the start of the procedure.
The withdrawal form must be signed by the User and contain the indication of the personal data of the same, the number of the order to which it refers, as well as the Products in relation to which it intends to exercise the withdrawal, identified by quantity, item description and relative price, as reported in the order summary.
If the return of the product is consequent to a defect of the same, the User must attach to the withdrawal form a photograph of the product taken in the part or parts of the product in which this defect is detectable.
Alternatively, the User can prepare an independent communication, provided that it is complete with all the elements present in the standard withdrawal form.
The communication of withdrawal lacking the requisites listed above, or received after the deadline of 14 days, will be considered null and void.

If the payment was made by cash on delivery, the refund will be made by bank transfer to the c / c indicated by the buyer in the notice of withdrawal. The right of cash on delivery is not refunded.
If the purchase was made using a discount code, the amount of the discount will not be refunded, the refund will be related only to the amount actually spent.
Please note that the product must be returned in a state of substantial integrity (for example, the products must be clean, free of scratches, damage, dents, abrasions. In order to exercise the right of withdrawal, the goods to be returned are not required to be insured against theft and accidental damage from transport. However, since the risk inherent in the return of the goods weighs on the buyer, Modalyssa invites the buyer who intends to exercise the right of withdrawal to insure, at his own expense, the shipment for the value indicated in the order confirmation e-mail. of purchase.
